PART A – TERMS OF USE

1. Acceptance of Terms

By accessing or using the websites, portals, platforms, and services operated by Vacay Vibes LLC (“Company,” “we,” “our,” or “us”), including our public-facing website and internal advisor portals (collectively, the “Site”), you agree to be bound by these Terms of Use.

If you do not agree, you must immediately cease all use of the Site. Any use of the Site constitutes acceptance of these Terms. You must be at least 18 years of age to use our services.

2. Scope of Services

The Company acts as a host travel agency connecting travelers with independent travel advisors (“Advisors”).

We do not sell travel directly via our Site and are not a party to any transactions between Advisors and travelers. All bookings are arranged independently by Advisors off-site.

Fees, refunds, cancellations, and changes are handled at the discretion of the individual Advisor and are subject to their own policies. Company assumes no liability for Advisor policies or transactions between Advisors and travelers.

3. User Responsibilities

As a condition of using our Site, you represent, warrant and agree to:

Provide accurate, current, and complete information when submitting inquiries or account details.
Use the Site for lawful purposes only.
Not misuse the Site, including but not limited to unauthorized access, data scraping, sending spam, infringing intellectual property rights, or interfering with system security.

4. Intellectual Property

All text, images, logos, brand assets, training materials, and other content on the Site are owned or licensed by the Company and protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent.

5. Booking, Payments, & Fees

The Site does not process or handle any travel payments directly, and Company assumes no responsibility for any payment-related disputes between Advisors and travelers.

Refunds, cancellations, and change fees are set by individual Advisors and may vary.
Advisors may charge service fees for cancellations, itinerary changes, or late payments.

6. Dispute Resolution

This Agreement is governed by the laws of the State of Florida, without regard to conflict of laws principles.

Any disputes shall be resolved exclusively in the state or federal courts of Palm Beach County, Florida.

The parties hereby waive any right to a jury trial.

The prevailing party shall be entitled to recover reasonable attorneys' fees and costs.

PART B – PRIVACY POLICY

7. Information We Collect

We may collect the following information from Advisors and travelers:

Contact details: Name, email, phone number, address
Billing information: Payment details (when applicable)
Travel-related information: Passport numbers, preferences, special requests
Technical data: IP address, browser type, cookies, device information

We use cookies, pixels, and similar tracking technologies for:

Website functionality
Analytics (e.g., Google Analytics)
Advertising and retargeting (e.g., Facebook Pixel)

Connect travelers with Advisors
Manage bookings through Advisors

We do NOT sell or rent personal data as defined under applicable privacy laws, including but not limited to the CCPA and GDPR.
